Terms of Service

1. Acceptance of Terms

By accessing or using Omunchle (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

2. Age Restriction

You must be at least 18 years old to use the Service. Omunchle involves live video of real people and is restricted to adults only. By entering the arena, you affirm that you are at least 18 years old. Misrepresentation of your age may result in immediate and permanent account termination.

3. Camera and Biometric Consent

Omunchle uses MediaPipe FaceMesh, running entirely inside your browser, to detect tongue movement for gameplay. By starting a match or Practice Mode, you consent to:

• Temporary, in-browser processing of your facial landmarks for the purpose of scoring tongue movement
• Transmission of your live video feed to your matched opponent via a WebRTC peer-to-peer connection

You may withdraw consent at any time by leaving the match or closing the browser. We do not store biometric data. Your video is never routed through or recorded by Omunchle's servers.

4. Code of Conduct

You agree not to:

• Display illegal, obscene, or harassing content on camera during a match
• Impersonate other users or misrepresent your identity
• Manipulate your camera feed, use scripts, or deploy any automated means to affect match scoring
• Harass, threaten, or abuse other users in any way
• Attempt to disrupt, overload, or interfere with the Service or its infrastructure

Violations may result in immediate account suspension or permanent termination without notice.

5. Guest Accounts

Guest accounts are temporary. Your ELO rating and match history are tied to a session token stored in your browser's local storage. If you clear your browser data, switch devices, or your session expires, your guest account data may be permanently lost. We are not responsible for lost guest data. To preserve your rank and history across devices, sign in with Google.

6. Account Responsibilities

You are responsible for all activity that occurs under your account. Do not share your session credentials. You must notify us immediately if you believe your account has been compromised. Third-party plugins or tools that alter tongue-tracking outputs during a ranked match constitute cheating and may result in account termination.

7. Match Content

By participating in a match, you grant Omunchle a limited, non-exclusive, royalty-free licence to transmit your live video feed to your matched opponent solely for the purpose of conducting the match. We do not record, store, or redistribute your video stream.

We will not use your name, likeness, or video in external marketing materials without your separate, explicit opt-in consent.

8. Intellectual Property

All content, code, branding, algorithms, and features of the Service are owned by Omunchle or its licensors and are protected by applicable intellectual property laws. You may not:

• Scrape, copy, or reproduce the Service or its data for any commercial purpose
• Reverse-engineer the scoring or matching algorithms
• Use the Omunchle name, logo, or brand without prior written permission
• Access the Service through unauthorised bots or automated clients

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee continuous uptime, accuracy of ELO ratings, availability of opponents, or fitness for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Omunchle's total liability for any claim arising from your use of the Service is limited to the greater of (a) the amount you paid us in the preceding 12 months or (b) $100 USD. This limitation does not apply to liability arising from gross negligence, fraud, or wilful misconduct.

11. Modifications to the Service

We may modify, suspend, or discontinue any part of the Service at any time without notice. We may update these Terms from time to time; the "Last updated" date at the top of this page will reflect any changes. Continued use of the Service after updated Terms are posted constitutes your acceptance of those changes.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the courts of Orange County, California.
